MonDiary Terms of Use

1. Acceptance of Terms

These Terms of Use ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and UKGADGETS LTD ("Company," "we," "us," or "our") regarding your use of the MonDiary mobile application ("App" or "Service").

By creating an account, accessing, or using MonDiary, you acknowledge that you have read, understood, and agree to be bound by these Terms, our Privacy Policy, and any additional terms disclosed when purchasing features or subscriptions.

If you are using the App on behalf of an organization, you represent and warrant that you have authority to bind that organization to these Terms.

2. Description of Service

MonDiary is a personal diary and journaling application that allows you to:

• Create, edit, and organize diary entries with rich text formatting
• Track your mood and emotional well-being
• Attach photos, videos, and audio recordings to entries
• Secure your diary with PIN, pattern lock, or biometric authentication
• Back up your data to cloud services (Google Drive, iCloud)
• Export your entries in various formats
• Access psychological insights and analytics (Premium feature)

The App is available on iOS, Android, and macOS platforms through their respective app stores.

3. Eligibility

To use MonDiary, you must:

• Be at least 13 years of age (or 16 in the European Economic Area)
• Have the legal capacity to enter into a binding agreement
• Not be prohibited from using the App under applicable laws

If you are under the age of 18, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.

By using the App, you represent and warrant that you meet these eligibility requirements.

4. Account & Security

4.1 Account Creation

MonDiary does not require traditional account registration. Your diary is secured locally on your device using a PIN code or pattern lock that you create during setup.

4.2 Security Responsibilities

You are responsible for:

• Creating and maintaining a secure PIN or pattern lock
• Keeping your security credentials confidential
• Setting up account recovery options (email or security questions)
• Maintaining the security of your device

4.3 Biometric Authentication

If you enable Face ID or fingerprint authentication, you acknowledge that:

• Biometric data is processed by your device's operating system
• We do not receive, store, or have access to your biometric data
• Anyone with registered biometrics on your device may access your diary

4.4 Account Recovery

We provide optional recovery methods including:

• Email-based recovery codes (6-digit codes with 10-minute expiry)
• Security question verification

Recovery attempts are rate-limited to protect your account security.

5. User Content

5.1 Ownership of Content

You retain full ownership of all content you create in MonDiary, including:

• Diary entries and text content
• Photos, videos, and audio recordings
• Mood selections and tags
• Custom templates

5.2 License Grant

By using the App, you grant us a limited, non-exclusive, royalty-free license to:

• Store your content locally on your device
• Process your content to provide App features (e.g., sentiment analysis)
• Transmit your content to cloud services you authorize (Google Drive, iCloud)
• Display your content back to you within the App

This license is solely for the purpose of operating and providing the Service to you. We do not access, read, sell, or share your diary content with third parties.

5.3 Content Processing

Your diary content may be processed locally on your device for:

• Sentiment analysis and mood tracking
• Psychological insights and recommendations
• Search and organization features

All content analysis is performed on your device. Your diary content is never transmitted to our servers or third parties for analysis.

5.4 Content Backup

If you enable cloud backup:

• Your content will be stored in your personal Google Drive or iCloud account
• You are responsible for the security of your cloud accounts
• Cloud storage is subject to the terms of Google or Apple

5.5 Content Deletion

You can delete your content at any time within the App. Deleted content:

• Is permanently removed from local storage
• Must be separately deleted from cloud backups if enabled
• Cannot be recovered once deleted

6. Subscriptions & Payments

6.1 Subscription Plans

MonDiary offers the following subscription options:

6.2 Payment Processing

All payments are processed through:

• iOS/macOS: Apple App Store
• Android: Google Play Store

We use RevenueCat to manage subscriptions across platforms. By subscribing, you also agree to RevenueCat's terms of service.

6.3 Auto-Renewal

6.4 Free Trial

If you start a free trial:

• You will have full access to Premium features during the trial period
• Your subscription will automatically convert to a paid subscription at the end of the trial
• You can cancel during the trial to avoid being charged
• Any unused portion of a free trial will be forfeited upon purchase

6.5 Cancellation

To cancel your subscription:

• iOS/macOS: Go to Settings > [Your Name] > Subscriptions > MonDiary > Cancel
• Android: Go to Google Play Store > Menu > Subscriptions > MonDiary > Cancel

Cancellation takes effect at the end of the current billing period. You will retain Premium access until then.

6.6 Refunds

Refund requests are handled by the respective app stores:

• Apple: Request a refund from Apple
• Google: Request a refund from Google Play

We cannot process refunds directly. All refund decisions are made by Apple or Google according to their policies.

6.7 Price Changes

We reserve the right to change subscription prices at any time. Price changes will:

• Be communicated in advance
• Not affect your current billing period
• Apply to subsequent renewals after notice

6.8 Restore Purchases

You can restore previous purchases using the "Restore Purchases" option in the App. This is useful when switching devices or reinstalling the App.

7. Free & Premium Features

7.1 Free Features

All users have access to:

• Unlimited diary entries
• Basic mood tracking
• 7 free themes
• Basic sticker set
• Manual cloud backup
• Text export (.txt format)
• PIN/pattern/biometric security
• 10 built-in templates

7.2 Premium Features

Premium subscribers gain access to:

• 13 additional premium themes
• 119 premium background illustrations
• 6 premium sticker sets (161 stickers)
• PDF export with formatting
• Data package export (.zip)
• Automatic cloud backup
• Advanced psychological insights:
  • Five Factor Wellbeing Assessment
  • Self-Actualization Journey
  • Cognitive Pattern Analyzer
  • Emotional Intelligence Tracker
• Unlimited media uploads

7.3 Feature Availability

We reserve the right to modify, add, or remove features at any time. Significant changes to Premium features will be communicated to subscribers in advance.

8. Intellectual Property

8.1 Our Intellectual Property

The App and its original content, features, and functionality are owned by UKGADGETS LTD and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

This includes but is not limited to:

• App design, interface, and user experience
• Pre-built themes and background illustrations
• Sticker sets and graphic assets
• Built-in templates
• Mood icons and emoji sets
• Algorithms and analytical features
• MonDiary name, logo, and branding

8.2 License to Use

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to:

• Download and install the App on devices you own or control
• Use the App for personal, non-commercial purposes
• Use Premium content if you have an active subscription

8.3 Restrictions

You may not:

• Copy, modify, or distribute the App or its content
• Reverse engineer, decompile, or disassemble the App
• Remove any copyright or proprietary notices
• Use our intellectual property for commercial purposes
• Create derivative works based on the App
• Sublicense, sell, or transfer your license

8.4 Feedback

If you provide feedback, suggestions, or ideas about the App, you grant us a worldwide, perpetual, irrevocable, royalty-free license to use, modify, and incorporate such feedback without any obligation to you.

9. Acceptable Use

9.1 Permitted Use

You may use MonDiary for:

• Personal journaling and diary keeping
• Mood and emotional well-being tracking
• Personal reflection and self-improvement
• Storing personal memories and experiences

9.2 Prohibited Conduct

You agree not to:

• Use the App for any unlawful purpose
• Attempt to gain unauthorized access to any part of the App
• Interfere with or disrupt the App's functionality
• Use automated systems to access the App
• Circumvent security features or content protections
• Use the App to store or transmit malware
• Impersonate any person or entity
• Use the App to violate any third party's rights

9.3 Content Standards

While your diary is private, you acknowledge that you are solely responsible for any content you create. You agree not to use the App to create, store, or distribute content that:

• Violates any applicable law or regulation
• Infringes intellectual property rights of others
• Contains child sexual abuse material
• Promotes terrorism or violence

10. Third-Party Services

10.1 Cloud Storage Providers

The App integrates with third-party services for cloud backup:

• Google Drive: Subject to Google's Terms of Service
• iCloud: Subject to Apple's iCloud Terms

10.2 Payment Processors

• RevenueCat: Manages subscriptions - Terms of Service
• Apple App Store: Processes iOS payments - Terms
• Google Play: Processes Android payments - Terms

10.3 Analytics and Diagnostics

• Firebase (Google): Provides analytics and crash reporting - Firebase Terms of Service
  • Firebase Analytics: Tracks app usage and engagement
  • Firebase Crashlytics: Monitors app stability and crashes
  • Firebase Authentication: Manages anonymous user sessions
• All Firebase services are subject to Google's Terms of Service and Privacy Policy

10.4 Service Availability

We are not responsible for the availability, reliability, or functionality of third-party services. If a third-party service becomes unavailable:

• Cloud backup features may be temporarily unavailable
• Subscription management may be affected
• Core diary functionality will continue to work offline

10.5 Third-Party Terms

Your use of third-party services is governed by their respective terms and privacy policies. We encourage you to read those terms carefully.

11. Disclaimers

11.1 "As Is" Basis

11.2 No Guarantee

We do not warrant that:

• The App will be uninterrupted, timely, secure, or error-free
• The results obtained from using the App will be accurate or reliable
• Any errors in the App will be corrected
• The App will meet your specific requirements

11.3 Psychological Insights Disclaimer

11.4 Data Loss

We are not responsible for any loss of data due to:

• Device failure, loss, or theft
• Forgotten PIN without recovery options configured
• Third-party cloud service failures
• User error or accidental deletion
• App uninstallation

You are strongly encouraged to enable cloud backup and maintain regular backups of your diary.

Note: Crash reports and analytics data are collected to help us diagnose and prevent data loss issues. This diagnostic data is used solely to improve app reliability and is governed by our Privacy Policy.

11.5 Apple Disclaimer

You acknowledge that:

• These Terms are between you and UKGADGETS LTD only, not with Apple
• Apple has no obligation to furnish maintenance or support services
• Apple is not responsible for any product warranties
• Apple is not responsible for addressing any claims related to the App
• Apple is not responsible for any third-party intellectual property claims

12. Limitation of Liability

12.1 Exclusion of Damages

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL UKGADGETS LTD, ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION:

• Loss of profits, data, or goodwill
• Service interruption or computer damage
• Cost of substitute services
• Any damages arising from these Terms or your use of the App

12.2 Liability Cap

OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO THESE TERMS OR THE APP SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR ONE HUNDRED POUNDS (£100), WHICHEVER IS GREATER.

12.3 Essential Purpose

THE LIMITATIONS IN THIS SECTION APPLY EVEN IF ANY LIMITED REMEDY FAILS OF ITS ESSENTIAL PURPOSE.

12.4 Jurisdictional Limitations

Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability for incidental or consequential damages. In such jurisdictions, our liability will be limited to the greatest extent permitted by law.

13. Indemnification

You agree to defend, indemnify, and hold harmless UKGADGETS LTD and its officers, directors, employees, contractors, agents, licensors, and suppliers from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable legal fees) arising out of or relating to:

• Your violation of these Terms
• Your use of the App
• Your content or data
• Your violation of any third party's rights
• Any claim that your content caused damage to a third party

14. Termination

14.1 Termination by You

You may terminate your use of the App at any time by:

• Deleting the App from your device
• Cancelling any active subscriptions

14.2 Termination by Us

We may suspend or terminate your access to the App immediately, without prior notice, if:

• You breach these Terms
• We are required to do so by law
• We discontinue the App

14.3 Effect of Termination

Upon termination:

• Your license to use the App ends immediately
• You must delete the App from all devices
• Provisions that by their nature should survive will survive (including ownership, warranty disclaimers, indemnity, and limitations of liability)

14.4 Data After Termination

Your local data remains on your device until you delete the App. Cloud backups remain in your personal cloud storage accounts until you delete them.

15. Changes to Terms

We reserve the right to modify these Terms at any time. When we make changes:

• We will update the "Last Updated" date at the top
• We will notify you of material changes through the App or by email
• Changes will be effective upon posting unless otherwise specified

Your continued use of the App after changes are posted constitutes your acceptance of the modified Terms. If you do not agree to the changes, you must stop using the App.

16. Governing Law

16.1 Applicable Law

These Terms shall be governed by and construed in accordance with the laws of England and Wales, without regard to its conflict of law provisions.

16.2 Dispute Resolution

Any disputes arising from these Terms or the App shall be subject to the exclusive jurisdiction of the courts of England and Wales.

16.3 EU Consumers

If you are a consumer in the European Union, you may also bring proceedings in your country of residence, and nothing in these Terms affects your statutory rights as a consumer.

16.4 Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

16.5 Waiver

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

16.6 Entire Agreement

These Terms, together with our Privacy Policy and any subscription terms, constitute the entire agreement between you and UKGADGETS LTD regarding the App.

16.7 Third-Party Beneficiaries

Apple Inc. and its subsidiaries are third-party beneficiaries of these Terms (for iOS/macOS users). Upon your acceptance of these Terms, Apple will have the right to enforce these Terms against you as a third-party beneficiary.
